As an attorney, she represents independent producers, television and film production companies, cable networks, newspapers and authors. Her clients have earned numerous awards, including prestigious film festival awards, Guggenheim fellowships, McArthur grants, an Oscar® nomination and a Peabody Award®.

She has worked in-house as both an attorney and a media executive. She was Director of Legal and Business Affairs for AETN Cable, an executive for Thirteen/WNET, and worked for several independent media companies. As an executive, she focused on the development, production, distribution and licensing of television programs and related ancillary products. For her own media work, Ms. Berry has been recognized with a number of awards, including 2 CINE Golden Eagle® awards, 2 Emmy® nominations, and 2 grants from the National Endowment for the Humanities.

Other areas: I have some long standing affiliations with media makers and distribution organizations.As someone who started arbitrating in the 1990's, I can talk not only about where we are today and what we need today, but also where we've been and why change is important.I often speak about the intersection of media production, media law, and ADR. Having worked in all three areas, it is easy for me to present situations that feel familiar to the audience and to come up with anecdotal stories or case studies to which the audience can relate.

My academic work includes more than 50 publications. Recently, in the LCIA Arbitration 163471, the arbitral tribunal cited one of my articles to support its reasoning and ordered CFE, the Mexican state-owned utility company, to pay claimants more than USD200 million. The claimants are enforcing this award in New York City. Additionally, I have co-drafted the book Comparison of International Arbitration Rules, with Hogan Lovells New York Partners Oliver Armas and Samaa Haridi. I serve as a mentor to young girls, women in college and to those internal committees on the companies to which I serve on their boards.
I was originally going to be in the liberal arts fields and had no training in the engineering technical areas before going to college. It was a university professor that spoke to our high school class that changed my mind to enter the field of engineering.
It was my first position on a project that came about through litigation that inspired me to the field of dispute resolution.
I have been lecturing and speaking in various capacities including University lectures, keynote speeches, webinars, conference panels and master classes since 1981. I have given lectures or presentation over 200 times. I take into consideration the audience and venue in determining the most effective means of delivery, whether that be an interactive format or one that provides value in the form of either a lecture or a key note presentation, always with the opportunity for questions.
I also had the honor to be commencement speaker for the graduating class of the South Dakota School of Mines where I also received an honorary doctorate in civil engineering.

Other: I have never been "certified" as an expert in any area of the law. Areas of expertise in the legal profession normally carry a certification prerequisite. Proficiency is a more appropriate designation for lawyers who have never sought certification of expertise in any one area of the law. I am confident that I can advise others that I am proficient in trial litigation and especially areas of general civil, tax and probate litigation. Those are areas that I focused on during my early years of practice. I am also proficient as a neutral mediator and unbiased arbitrator. I can manage litigated matters efficiently and timely. My favorite area of ADR work is the mediation or arbitration of sports related disputes. As a lifelong athlete, volunteer and sports enthusiast, assisting with the resolution of sports related disputes gives me the greatest personal satisfaction at this stage of my professional life.My father's family came to the Southwest during the Spanish Land Grant era in the 1700's. My great grandmother was Native American (Isleta Pueblo). The family survived in the Rio Grande Valley as farmers and shepherds for multiple generations. Living off the land in the desert southwest for hundreds of years is a great testament to the generations that preceded me. My mother's family is of German and English dissent and resided in the Mississippi delta region for several generations until the end of the Great Depression.

When we view people in the lens of diversity and inclusion, I have always considered myself to be a stark example of the melting pot in America. I see and process everything through a variety of multicolor lens. This unique background and perspective have guided me through the labyrinth of my life and served me well. It has also given me diverse skillsets that others find intriguing. Translating this rich history into an interesting public presentation has always been a work in progress. I would enjoy more opportunities to touch others with unique stories that they might relate to.
I am not asked to speak or present to non-legal audiences very often, even though I have done so. I have been a CLE speaker/presenter on numerous occasions during my career. Most recently, I have been asked to serve on various panels of judges who present a particular topic to a legal audience (CLE, etc.) and respond to questions. Other than my background, educational degrees and work experience, I have no formal training or degree in "public speaking" or "communications."

Upon divorce, there are rules in place that are based on thousands of years of religious practice. In many communities, including but not limited to Orthodox Jews, traditional Muslim, and Christians, the end of a marriage can be a shameful experience. The rift between the couple is a deep disappointment that affects each individual but also his or her extended family. It is not a secret that divorce matters have an emotional intensity that few other legal practice areas have. When you combine stigma, family honor, unresolved anger, and an adversarial legal forum, otherwise simple divorce matters can become very complex to handle. In my presentations and CLE programs, I address legal, cultural and psychological issues regarding religious divorce, and how they intersect with civil divorce proceedings.
I have over 25 years of experience in presenting CLEs and keynote presentations to state and national bar associations, NADP, WBASNY and AFCC. I have also presented for Girl Scouts, and panel presentations for women's groups, religious organizations and major financial institutions.

On April 20, 2021, I was invited to speak for the Franklin H. Williams Judicial Commission with regard to issues of diversity along with a panel of speakers, at the invitation of Lauren Jones.

Prior to her appointment to the state’s highest court, she was elected to the Division II of the Circuit Court of Tennessee for the 30th Judicial District at Memphis, While on the circuit court, she created an alternative dispute resolution pilot project to explore the uses of mediation, non-binding arbitration, and early neutral evaluation in Shelby County, Tennessee.

Justice Holder is a summa cum laude graduate of the University of Pittsburgh and a graduate of the Duquesne University School of Law where she was Recent Decisions Editor of the Duquesne Law Review. She served as a law clerk for Judge Herbert P. Sorg of the United States District Court for the Western District of Pennsylvania. In 2010, she was named a Legacy Laureate by the University of Pittsburgh and in 2012 received its 225th Anniversary Medallion. She received the 2015 University of Pittsburgh Kenneth P. Dietrich School of Arts and Sciences Distinguished Alumni Award. In 2015, she was inducted into the Tennessee Women’s Hall of Fame by the Tennessee Economic Council on Women.

In 2008, she received the Grayfred Gray Public Service Mediation Award from the Coalition for Mediation Awareness in Tennessee and served as the Tennessee Supreme Court Liaison to the Alternative Dispute Resolution Commission for nine years prior to her retirement. Kern-Rappy, Michele - Senior mediator and senior settlement coordinator, New York State Supreme Courtmkernrap1@optonline.netMichele Kern-Rappy is the founder and Senior Settlement Coordinator of the New York State Supreme Court’s comprehensive in-house Mediation Non-Jury Program (“Med-NJ”). Kern-Rappy first joined the New York State Supreme Court as a court attorney in the 1980s, where she spent decades working in judge’s chambers on settlement conferences. In 2014, Kern-Rappy mobilized her decades-long tenure with the Supreme Court to create its Med-NJ program and spearheaded its meteoric rise to success.

After thirty-three years and thousands of court-annexed mediations, Kern-Rappy has mastered the art of shifting the mindset of litigants from formidable adversaries to collaborators and helping them achieve resolution. This shift in mindset, from adversary to collaborator, laid the groundwork for what has become Kern-Rappy’s trademarked model for mediation, RAISE—To A Higher Road. Over the years, Kern-Rappy taught her model for mediation across several courts systems and within the greater mediation community.

The success of Kern-Rappy’s Med-NJ program and trademarked model for mediation catapulted her onto the radar of the entire New York State Unified Court System. In 2018, Kern-Rappy was invited to join Chief Judge Janet DiFiore’s ADR Advisory committee to help launch a statewide initiative for presumptive ADR, with a focus on court-sponsored mediation.

Kern-Rappy serves on many ADR advisory groups for the New York State Unified Court System and the New York Bar Association, including the Honorable Deborah A. Kaplan’s Tort Advisory Committee, the NYSBA’s ADR In The Courts Committee, and she is Co-chair of NYWBA’s Special Committee on ADR. Among his many high-stakes matters, Mestre successfully represented a Chevron attorney in a case that was part of the $100 billion, 18-year litigation over Chevron’s alleged environmental damage in the Amazon. As part of the defense, a series of U.S. discovery proceedings were commenced that ultimately resulted in the Second Circuit ordering the production of more than 600 hours of outtakes (the most ever to be ordered produced in U.S. history) from “Crude”—a film about the litigation.

Mestre currently represents Dr. Craig Wright in a lawsuit that alleges he is the inventor of the crypto currency Bitcoin—and the blockchain itself— and that he has stolen half of the $22 billion fortune thus created.

As a Cuban-American himself, he has been active for many years in the Cuban American Bar Association (CABA) and has done extensive pro-bono work through CABA, Catholic Legal Services of Miami, and Greater Services of Legal Miami, including representing unaccompanied minors from Central America in dependency and immigration proceedings. I left Corporate America and founded a national mediation, arbitration and consulting firm as a non-lawyer. My career reflects my ability to build relationships and navigate new landscapes with the help of mentors and sponsors. I am proud to pay it forward as the co-founder of HBCU IMPACT, a non-profit initiative to attract, educate and employ diverse talent from historically black colleges, universities and law schools into insurance, legal and ADR career opportunities. I am frequently invited by bar associations, organizations and educational institutions to speak about matters of diversity and how to increase the selection of diverse neutrals. As the Diversity Committee Co-chair for the American Bar Association's Dispute Resolution Section, I am actively working on initiatives to bring visibility to efforts (ABA Res 105 and Ray Corollary Initiative) created to encourage the selection of neutrals in diverse classifications. I believe that the inclusion of people from varied backgrounds, personal and professional cultures, skill sets, experience and thought processes makes for a richer environment and experience. As an attorney and the founder of one the leading "Conflict Consulting" firms in the US, I draw from research in the fields of behavioral economics, psychology, medicine, and learning and development to produce programs that are impactful and transformative.I try to build D&I insights into all of my work, without making it feel heavy handed or uncomfortable. One of my favorite trainings involves the Hogan Values survey. By the end of the training, which never mentions race or gender or other cohorts or particular community, participants can feel and understand why diverse perspectives are necessary to drive the best outcomes. As a young woman, I applied to and chose to attend "Claremont Men's College," soon to be renamed Claremont McKenna College. I never felt disadvantaged during school, but it contributed in the long run to my understandings about how education, mentorship, neuroscience, and community can advance inclusion and equity. Thirty-five years later, as a member of the board of trustees, I am spearheading a new engagement initiative focused on Inclusion, Belonging, Inspiration, Mobilization, and Contribution.As a neuroscience nerd, I know that we learn best when we are personally engaged in an activity. My sessions are built around opportunities to make learning relevant, interactive, interesting, and (where appropriate) even fun! Conflict management does not have to be a downer - the topic should feel encouraging and inspiring. As professor, I've taught undergraduates and MBA candidates. As founder of Bridge Leadership Solutions, I've delivered trainings for a wide variety of audiences, including boards, tech company employees, law firms, workplace teams, women's groups, and start-up founders. In the last few years, I've enjoyed
the opportunity to deliver zoom trainings for audiences in Singapore, India, and the UK, among other global locations.

Throughout my life, I always wondered why it was so difficult for me to conform and be 'normal' like everyone else no matter how hard I tried to fit in.

It was always me against the rest of the world. I was always the outcast, and whenever I suggested ideas that were unfamiliar and not 'popular', I was never taken seriously, especially when those ideas could have an effect on altering the status quo or challenging cultural norms.

When I finally decided to take matters into my own hands after experiencing the above that left me with almost no regard for my self worth, my diagnosis (of sorts) assured me that neurodiversity, at least for me, is a gift.

Having begun my professional career abroad, I know what it is like to be an outsider in a group. I try to keep this perspective in mind when I am mentoring those who are under-represented in our profession. This perspective also informs how I deal with my clients and witnesses, who also often feel like they are in a "foreign country" when they step into a courtroom.
I speak frequently on issues related to arbitration, energy and technology, and women in the law. I have spoken by Zoom, in person, and have moderated panels before diverse audiences.

I am often invited back as a speaker because I am enthusiastic and honest in my assessments. I know that attention spans can be limited, so I lead with the headline and am not afraid to improvise if needed to respond to an audience.
